1) Reservation of Rights: All rights not expressly granted are retained by the Artist, including any electronic rights or usage, and including, but not limited to, all rights in sketches, or other preliminary materials. Any use additional to that expressly granted in writing requires arrangement for payment of a separate fee. Client may not alter the final Work in any way except to change its size for printing or display purposes. Any alterations after the Work is completed must be agreed upon by the Artist, and she will be allowed first option to make such alterations when possible. The Artist retains the right to display the Work for promotional purposes (such as a flyer printed with design examples).
2) Revisions: Reasonable revisions may be made only by the Artist and only at the sketch stage unless otherwise specified. Additional fees will be charged for revisions made after sketches have been approved.
3) Cancellation Fees: Cancellation fees will be based on the amount of work completed. Finished sketches count for 50% of work completed. 100% of the total fee is due despite cancellation if the job has been completed. Upon cancellation all rights to the art revert to the Artist and sketches, comps, or any other work produced by the artist in regards to the project must be returned if applicable. The Artist reserves the right to cancel the contract at any time; If the cancellation is due to circumstances beyond the Client's control (such as death, incapacity, or default of the Artist), then a full refund will be given.
4) Payment: Payment is due upon commissioning unless otherwise specified in the contract. The Client's right to use the work is conditioned upon receipt of full payment and Client's compliance with the terms of this contract.
5) Delays: Client agrees to give the Artist more time to complete the work as deemed reasonable if she is delayed by events beyond her control, like: fire, theft, disability. If such a situation were to occur, Client would be given the right to terminate this Agreement without penalty if the Artist fails to complete the artwork within 60 days of the agreed delivery date.
